Any owner of a dog involved in a attack is responsible for their pets actions. This is especially true in a non sanctioned dog park as its really just considered a green area so unprovoked attacks are not the norm, just the opposite. I think any owner of a pet that is attacked should pursue all avenues of action. Take the owner to court, find out where he lives and report this dog to the correct people, be sure to tell them how vicious it is. talk to the neighbors has there been problems before? Does this dog have a history of attacks be it against people or pets. Talk to people at the park have they had problems with this same dog. post a picture of dog and owner on park gates to alert all of a potential problem. If nothing is done this will certainly happen again and maybe the next dog attacked will not fair as well.

I hope that Mr. Hirsch reads this website, and realizes that he should no longer bring this particular Rottweiler to dog parks, to protect himself from lawsuit, as well as to protect other dogs and people!

The doctrine of assumption of the risk should not apply because the victim cannot be regarded as accepting the risk of such negligent, reckless and possibly illegal conduct.”
